The Department of Energy (DOE) considered alternatives to Yucca Mountain as a high-level waste dump under President Barack Obama. The Secretary of Energy’s Blue Ribbon Commission on America’s Nuclear Future delivered its final report in January 2012. It stated that a site suitable for the construction of a consolidated geological repository was urgently needed, and that any future facility should be developed by a new independent organization with direct access to the Nuclear Waste Fund that is not subject to the same political and financial controls as the Cabinet-level DOE. However, the site was met with fierce resistance in Nevada, especially from then-Senator Harry Reid.

The DOE has halted deep borehole and other non–Yucca Mountain waste disposal research under President Donald Trump. The DOE requested $120 million from Congress in FY18, while the NRC asked $30 million to continue licensing work for the Yucca Mountain Repository. The DOE requested $120 million again for FY19, but the NRC boosted its proposal to $47.7 million. For the balance of FY18, Congress opted not to grant any funding. Representative John Shimkus proposed a bill for the site in the House in May 2019, but an amendment by Representative Mike Simpson to add $74 million in Yucca Mountain money to a DOE appropriations bill was defeated by the Appropriations Committee. Under Secretary of Energy Mark W. Menezes stated before the Senate Energy and Natural Resources Committee on May 20, 2020, that Trump is opposed to the Yucca Mountain Repository being built.

Energy Secretary Jennifer Granholm stated in May 2021 that Yucca Mountain will not be included in the Biden administration’s nuclear-waste disposal plans. She expected the department’s next moves to be announced “in the coming months.”

What is the Yucca Mountain controversy?

The state’s concerns about Yucca Mountain stem from how it was selected in the first place. The country’s nuclear weapons program had left tons of radioactive waste, and spent fuel from nuclear power reactors was piling up when Reagan signed the Nuclear Waste Policy Act of 1982. Carbonate rock lies beneath the tuff, produced from deposits deposited at the bottom of ancient oceans that once existed in the area.

Lower Saxony only agreed to the 2013 site selection law if the Gorleben salt mine investigations were halted and no more atomic waste containers were delivered to the neighboring interim storage facility.

Existing facilities for waste with insignificant heat generation at Morsleben and the old salt mine Asse, which will cost several billion euros to repair, have eroded public confidence in the safety of nuclear waste sites. The situation is particularly bad at Asse, where over 200,000 m3 of low and medium-level waste must be removed from unstable mine tunnels partially flooded with groundwater (influent saline solutions), raising fears that radioactive materials may pollute surrounding drinking water. The ministry estimates that getting the leaking radioactive barrels out of Asse, which were deposited in 1967, will take until 2033.

It is unclear where the Asse waste will be stored after that. Minister Hendricks proposes in the revised waste disposal plan that the final repository for high-level waste be able to hold the 200,000 m3 from Asse. According to critics, this will make finding a final repository even more difficult because putting heat-generating waste and low and medium-level garbage together necessitates various conditions and, most importantly, a lot more room.

“The search can begin”

The Bundestag of Germany approved a joint bill submitted by the ruling coalition of CDU/CSU and SPD, as well as the Green Party, in March 2017 authorizing the search for a final repository. Before the search’s projected conclusion in 2031, the law specifies that the public will be “extensively involved” through “open participation procedures.” “A nuclear technology that we’ve just used for 60 years would effect more than 30,000 generations,” Hendricks said in a speech before the decision in parliament.

The Federal Company for Radioactive Waste Disposal (BGE), which prepares reports and hosts stakeholder participation events, is the principal entity in charge of performing the search.
