I’m devastated that the Packers won’t be participating in the Super Bowl next week. In terms of the Pack, the first part of my life did not bring much success. Three Super Bowl appearances have, however, been made in the second half, which is very thrilling.
During Super Bowl XXXI in 1996, I was a law student. Several buddies gathered to watch the Packers defeat the Patriots. We consumed a large number of appetizers and a large number of pizzas. The majority of the men preferred beer, whereas the women preferred margaritas.
The beer/margarita conundrum was resolved by the time Super Bowl XLV, in which the Packers defeated the Steelers, rolled around in 2010. The two beers are combined in the five-flavor Bud Light Lime-A-Rita, which was just released by Anheuser-Busch. The brewery claims that it has “the fantastic flavor of a lime margarita with a twist of Bud Light Lime for a refreshingly cool finish.
However, Anheuser-Busch is already in court over its beer-margarita hybrid for this year’s Super Bowl XLIX.
Sheila Cruz launched a class action complaint against the beer manufacturer, claiming that the company used misleading product labels. She alleges Anheuser-Busch falsely claims Bud Light Lime-A-Rita has fewer calories than any of its other products, when in fact it has more calories than any of them.
According to Cruz’s court documents, an eight-ounce Lime-A-Rita can has around 220 calories and 21.9 grams of carbs. However, a 12-ounce can of Budweiser contains 10.6 grams of carbs and around 145 calories. In comparison to Bud Light Lime, which has 116 calories and 8 grams of carbohydrates per can, Bud Light has around 110 calories and 6.6 grams of carbohydrates per can.
The lawsuit claims that Anheuser-Busch deceitfully suppressed, omitted, and misrepresented the products’ calorie counts. Cruz’s lawsuit is attempting to establish a class action status for all customers who have bought any variety of Bud Light Lime-A-Rita since it was initially released in 2008. Cruz brought his lawsuit in Los Angeles state court at first, but Anheuser-Busch successfully moved it under the Class Action Fairness Act to the Central District of California federal court.
Cruz’s odds appear good simply because a smaller can of Bud Light Lime-A-Rita has twice as many calories as a can of Bud Light and around 50% more calories than a standard Budweiser. But a Bud Light Lime-A-Rita certainly seems light in comparison to the usual margarita, which contains roughly 450 calories “light.
The case’s defense by Anheuser-Busch will be interesting to watch. By equating the beverage with beer, Bud Light, the brewer may be subjecting themselves to a false advertising claim if they claim that Lime-A-Rita is a lighter alternative to a margarita.
Anheuser-Busch finds itself in a difficult situation. It makes me think of the Packers’ predicament versus the Broncos in the closing minutes of Super Bowl XXXII. With 1:47 remaining, Coach Holmgren had to choose between letting Denver score so that the Pack would have time to tie the game or standing his ground and possibly losing to a last-second field goal. Anheuser-Busch desires a happier conclusion than the one we had.
